Last Minute Stay

The Baltimore Sun
February 6, 2006

"The state Court of Appeals issued several orders this morning granting defense lawyers' request for a stay in the execution. The court scheduled arguments in the case for May.

We continue to think that we have strong claims and meritorious appeals, and we're very glad that the court is going to give us a chance to show them that," said A. Stephen Hut Jr., one of the lawyers who has represented Evans in his appeals.

The attorneys said they were still sorting out the appeals court's orders this morning, but that a majority of the judges appeared to grant the lawyers' requests for a stay on each challenge pending before the appeals court...

"Evans, who had been moved to a cell closer to the state's death chamber, was told of the court's decision shortly before noon, the Associated Press reported.

He said, "Praise God," according to Jeffrey O'Toole, one of his attorneys."

ROCK N' ROLL!!!!!!! It has been said that God has a way of showing up for people at the "11th Hour."

Vernon's lawyers have obviously build a solid case for overturning his death sentence -- and perhaps a new trial as well -- predicated on four solid issues that will probably not only save his life, but those of many others on Maryland's Death Row.

I find it absolutely ludicrous that prosecutors "always" seek the death penalty in Baltimore County for Capital Murder. This is not the case throughout the remainder of Maryland. To the courts, and any constitutional scholar, this is a clear indication that the death penalty is not applied fairly in that state. It should never be about "where you pull the trigger."

I'm not a religious man but Thank God for decency and humanity. Perhaps now at long last the witnesses who said that Vernon was not the killer can be heard.
There were some vultures who said they were going to rejoice at Vernon's execution To "laugh and cheer" said one. Well my wife and I are going to have a drink to celebrate Vernon being spared an injust death. Well done

It is a shame that someone can get away with MURDER!!!! The death penalty is fair. If you are convicted of murder, you should then be executied within 24 hours the same way that your victims were killed by you. Here's to the courts sticking us taxpayers with taking care of another drug thug who probably has a law degree that we paid for while other law abbiding citizens have to strugle to make it lagally. I guess we can now look forward to a week off in January now with the deaths of Mrs. Parks and Mrs. King and the LEGAL EXECUTION of Tookie. I guess "Thank GOD" for partial justice

to "death penalty" Oh so you don't mind that there is witness evidence that Vernon was not the killer? What, just so they execute somebody regardless of a potential miscarriage of justice?? If there is even the slightest doubt of his guilt and there obviously is, or there likely would not have been a stay, he has no business being on the gurney, does he? I hope you do not advocate the murder of a possibly innocent man...What would that make you?

"deathpenalty" and his shallow, insensitive, hateful attitude is just another example why Europeans generally have such a low opinion of the American mentality.Capital Punishment is just another bizarre concept that belongs on the same page with slavery, racism, sexism, homophobia, the illegalization of Marijuana and the lack of gun control -- practices that certainly detract from this country's self-image of "the most civilized nation on earth." No wonder our more evolved friends across the Atlantic have a difficult time understanding us.

In your last minute think about God and you'll stay with God in heaven for ever and ever. God is good, God is all for us. God bless you Vernon.

To gsryoga Well said. I fear "death penalty" is in serious danger of exposing himself as a psychopath !!! He does not seem to care whether Vernon is innocent or not just so long as someone is killed to satisfy his blood-lust.

gsryoga There was even one blogger who tried to tell me that he would or could "hunt down" and kill drug dealers outside the law and escape justice by claiming he was in the American army and the army would not punish him. Doesn't give a very good impression of the army does it?!! It may be reasonable to predict that at a certain date in future we will be arguing for him to not be executed !! Difficult..Difficult !!

gsryoga,
Why wouldn't you want to join your 'more evolved friends across the Atlantic?' I'm not trying to have a shot here I'm just intensely curious as to how so many Americans can talk about how much better the people & place are everywhere else but continue to live there....If you hate it & the mentality there so much, leave.

Hello Daydreamer It's difficult isn't it to actually move to another country and inevitably another culture and old relationships get lost in the post after a while. I had a fantasy when I left the U.K. that Spain was heaven and at first it was, but then I went through a very hard period and reality struck. I could have returned to the U.K. at that time But I decided to stay the course. Then I married the woman of my life !! and things changed very much for the better. We now own several houses in different places and spend most of our free time in a mountain mansion with several acres of land and many animals. Life for me now is delightful, hard work and vibrant. For me the risk paid off in all senses. You need to be a person who can make friends easily to make a successful transition. Many people would like to switch cultures but the practical realities and risk involved put many people off actually doing it.

Well done! All our prayers have been answered. To execute Vernon now at some future date really would be cruel and unusual. Let us hope this stay of execution can be made permanent. Hwyl fawr! (Good luck!)

If these people were not extremists, they probably would not have trouble making friends.
You seem to be a very giving person. Perhaps you could house some of these people in one of your many homes & supply them with some therapy.

Hello Daydreamer thanks for that. that would be nice would't it ! To be happy in life is what really matters but to achieve that can mean a lot of hard work.

amen to those of you who think that vernon deserves a stay of execution. I heard about his case last week and I think that his stay of execution for now is well deserved and that his attorneys should do what ever is possible to get that witness in there and testify. To those of you who think that the death penalty in this case should still be done like right now well I pray for you. Put your self in Vernon's family's shoes how would you feel if your loved one was set for execution would you want him or her to die the same way their victim died??? think about that

Hello gsryoga
Yes i'd be glad to but although I put time aside for a few days on this blog because of strong feelings, I honestly don't have a lot of time for regular correspondence. Apart from my normal work I'm also working on television programmes and preparing books on original research I have done related to memory and acoustic imagery and psychodynamics. So please forgive me if I am a bit slow in replying ! I'll send you an email but now that Vernon has another chance at fairer justice I won't be a regular at this site anymore.

Deathpenalty would just add a new murder to a too long list.
Vernon being or not guilty is not the question. Killing Vernon will never prevent any further murders. In countries where deathpenalty has been cancelled, the number of murders didn't increase. In 2002, in France, Patrick Dils has been recognized as not guilty after having spent 15 years in jail for a murder. If deathpenalty was still used in France, he would have been killed before...

To titophe One more go before your "resident psychologist" ha ha signs off. I could not agree more with you. If you pardon the pun, I'm dead against the death penalty but when you have been arguing with advocates of death, the only argument you can really win on is that of the potential execution of an innocent man. If you read my in-depth arguments in other sections of this web page about child development, abuse and behaviour, you will see the stand I take. And one other point. Can you believe the studies that negate the theory that a constant diet of violent films promotes violent behaviour in child to adult? My God ! I have to question what subjects were selected for those studies. If a child abused person learns that rape and violence done to them is a normal way to communicate and then they are awash with short term advantage seemingly gained from violence in films, that does not provide a very good education does it? I think that film-makers who rely on more and more violence to stimulate andrenalin carry a heavy responsibility for manipulating the abuse-damaged and vulnerable- to-manipulation child to adult individuals if you can follow all that. I can tell you one thing. Violence appears nowhere in my films !! I believe I have more imagination than that and violence is completely unnecessary to capture the imagination. And now I must get back to those films with no violence ! Best wishes.

To titophe Just a short message ( !! ) I am preparing a series of applied science television programmes and books that relate to memory and psychodynamics in a practical context, initially for Spanish television ( I live/work in Spain) and I am in negotiations with global educational channels as well.

To John:

I should have put short into brackets ;-)
Of course, I agree with you regarding violence on TV.
That being said, deathpenalty is not just a question of TV. This is a question of differentiating a state, a country, from an individual. I can understand for a victim the willingness of revenge. In such a position, I also could feel the same desire. But an official country justice organization is not an individual. Emotions should get out of any decisions. My own point of view is that countries allowing deathpenalty are doing a big mix-up between justice and emotions.

Blogger john said...

Oooo !! I totally agree with you. That is what I meant when I said in another blog section that the death penalty is a projection of anger.

Some blogger said something about "our more evolved friends across the Atlantic have a difficult time understanding us."
And I would like to use those words to make my point.
but first I'll leave a small introduction, I'm european, non religious, 25 years old, born in one place, studied in another, worked in a different country.
Having said that, It's a fact that most people (about 85% last I read) dislikes america, and doesn't understand it, but it's not just because of your death penalty.
I think everyone here agrees that murder is a vicious crime, what ever the reasons for it. so it's really unreasonable and contradictory to allow a "lawful" death penalty even if one the one beeing murdered is a murderer.
it's also unreasonable, that a person is convicted, and the sentence is carried out 22 years later, but good for that in this case.
In europe it's true we don't have death penalty, and the life sentence is for insanity. yes, we considerer mass murder a insanity, but a state of mind. But here prison is seen not only as a punishment, but as a social reintegration tool.
In America, jail is seen only as a punishment.
I don't know if Vernon is guilty or not, I'll leave that for your judicial system to decide, but it makes no sense this case at all.
Now being a little sarcastic as I am, China also has the death penalty, and it's carried away quite efficiently, but they are so many, nobody counts, and it's a poor country, so more for the others. America is a wealth country with a huge gap in the middle, where the poor are just as poor anywhere else on the planet, but you still have doubts about killing or not another human beeing.

< an now my politic satire --- couldn't expect more from someone who votes twice in bush>

No one overturned his death sentence, he has a reprieve from the lethal injection, Maryland has 2 forms of death, gas and lethal injection. He will die just a matter of getting the chamber ready.
